5. Intellectual Property

5.2 Client Ownership
Upon full payment, you will own the final deliverables (website, content, etc.) created specifically
for your business. However, we retain ownership of any proprietary tools, templates, and frameworks
used in creating your deliverables.
6. Service Delivery
- Estimated timelines will be provided in your service
agreement
- Timelines may vary based on client responsiveness and
requirements
- We reserve the right to extend timelines if delays are
caused by the client
- Revisions are subject to the terms specified in your
agreement
7. WhatsApp Automation Compliance
By using our WhatsApp automation services, you agree to:
- Comply with Meta's (Facebook/WhatsApp) Business and
Commerce Policies
- Only send messages to customers who have opted in to
receive communications
- Not use automation for spam, harassment, or illegal
activities
- Maintain proper customer consent records
- Take responsibility for the content of messages sent
through your account
8. Limitation of Liability
CareTechMobile shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Issues arising from third-party services (hosting,
WhatsApp, payment gateways)
- Damages exceeding the amount paid for services
9. Warranty Disclaimer
Our services are provided "as is" without warranties of any kind, either express or implied. We do
not guarantee specific results, such as increased sales or customer engagement, as these depend on
various factors beyond our control.
10. Termination
Either party may terminate services with written notice. Upon termination:
- Outstanding payments become immediately due
- Access to our tools and services will be revoked
- You retain ownership of completed deliverables (upon
full payment)
- Refunds are subject to our Refund Policy
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes
shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon
posting on this page. Continued use of our services after changes constitutes acceptance of the
modified Terms.
